Farrah Abraham Charged With Assault: Will She Actually Go to Jail?

Back in January, Farrah Abraham slapped a security guard while partying in a Los Angeles club.

Following the alleged attack, Farrah was cuffed by a different security guard and placed under a citizen’s arrest.

Abraham alleged that she was “battered and assaulted” by the club’s staff, and she likely hoped that the threat of a lawsuit would be sufficient motivation for her victim to drop the charges.

But that didn’t turn out to be the case.

According to a new report from In Touch, Farrah has been charged with with “battery on a peace officer or police officer.”

Yes, this is far more serious than a mere simple assault charge.

In fact, under California law, Farrah might as well have assaulted a cop.

When the incident took place back on January 16, Farrah’s attorney Dario C. Gomez told the press that “no charges had been brought against” her.

He also claimed that Farrah “was the victim in all of this, not only of physical and emotional injury, but also of negligent investigation by security staff at Grandmaster Records and the media at large.”

But on June 2, Farrah was formally charged with assault, and it seems that the former Teen Mom might be in for a very messy legal battle.

While it appears unlikely that Farrah will do time for a drunken slap, it’s certainly not impossible.

Her fate might depend on whether or not prosecutors can convince the jury that Farrah knew she was assaulting a peace officer in the line of duty.

“If the prosecution can prove that you knew or reasonably should have known that you were committing battery against such a person, then the sentence for a battery not causing any injury increases to a maximum one (1) year in county jail.”

Shortly after the arrest, Farrah checked into rehab to be treated for what she described as a trauma-related mental health issue.

On social media, Farrah railed against the man who handcuffed her in a series of lengthy rants:

“No woman or man should ever be battered, abused, conspired, gang up on, set up, recorded and video sold,” Abraham wrote at one point.

“I’ve had a very traumatizing year and I don’t deserve to be attacked, bruised, men on me, and battered,” she later alleged.

“As a single mother to be harassed, battered, and conspired against as a paying customer @grandmaster_recorders should fire their management, and security for all contributing to attacking 1 person out of 3 people.”

From there, Farrah expressed her gratitude to the “Hollywood police for rescuing” her from “being held against her will and being attacked.”

Farrah’s not the most sympathetic figure on the planet, and many commenters accused her of praising law enforcement in the hope that doing so might help her to avoid being charged.

So it’s more than a little ironic that she’s now been charged with assaulting a peace officer.

Farrah has not publicly responded to the news that she could be facing jail time.

Of course, if this goes to trial, you can be certain that she’ll plead not guilty and take the witness stand in court.

We’re sure Ms. Abraham would love nothing more than a media circus that’ll make Depp v. Heard look tame by comparison!
